Laws are made for Citizens--not the Citizens are made for Laws

Today I was reading an article by Madabhushi Sridhar (A Professor and Coordinator, Center for Media Law and Public Policy, NALSAR University of Law, Hyderabad) throwing light on the constitutional aspects of the capital punishment to Ajmal Kasab and raising questions on the integrity of the Govt.I found his article technically right but it lacks the sense of being human in it.




Though article-72 of the Indian Constitution gives every requester,the chance to appeal again for a judicial review if the plea of pardon(mercy petition) is being rejected by the President yet a Govt can't be blamed for not informing regarding such a provision to the accuser.Here,what the author has blamed that Govt has the responsibility to inform the Kasab regarding the same which it deliberately denied to do so.I am asking,if Govt did it deliberately then also whats wrong in it, after all laws are made for citizens(or persons as said int he article) and not the citizens are made for laws in a democracy.

Why a person who writes an articles puts aside his feelings when it comes to show knowledge on a paper?Why a person instead of listening of his or her own heart and mind tries to express more of his knowledge whether it should be expressed or not ? All what is said is technically right and the examples given are also constitutionally true but for whom it is being written should also be kept in mind while writing .What about the 166 people who killed in the attack when someone calls for another review,this time by the judiciary.After all the law is for the citizens and truth and not for giving a chance by chance to the culprit though just on the name of human rights even when the culpability of the accuser is proved in the apex court.

Writer,Constitution Experts and even nation  need to rethink a lot.

Other side of the Coin - Hanged Kasab

The most awaited hanging for Indians had a real execution today.Country was awaiting this moment for last four years and finally the victims of 26/11 had a justice.Faith in the Indian Judicial System and moreover in the political system is regained to a great extent today.It is proved by today's action that- 'Where there is a will,there is a way'.Whole country is happy that even after so much days justice is given,no problem but finally it is given,that matters.All are delighted by the action only one side of the coin that justice is given but other side of the coin has a harsh face.Lets have a look at it.

There is a great chance that 'Kasab' would be taken in as a hero or celebrity in the terrorist community which will provoke them more keeping this young man as their ideal.Early they did not had a face to follow who was sentenced like this for the cause of their aim but now they have.New trainee camps would have a face whom they can use to guide their guys in the wrong direction,probably right for them.


Another point I have in mind that why in the dilemma of political spectrum,two different approach for two different types of persons involved in two separate terrorist activities but both shooting the heart of the nation,one to the political temple and another to the busiest city of the nation.The political approach for the terrorists should be same irrespective of religion and vote bank politics.Only this is required,rest all will be fine automatically.For that I would reiterate above said proverb again-'Where there is a will,there is a way' and I hope this first ray of hope will help in reaching out to the destination like Sun and Indian Judicial and Political System would regain its lost credibility.

'Ek Thi Freedom of Speech'-The Facebook Row

'Ek Tha Tiger' is a reality or not,don't know but 'Ek Thi Freedom of Speech" is getting realistic these days.It can be predicted by the series of attempts in last few months to shut the voice of people which is getting against you.Recent event of Maharashtra is an active example of the hammer on the table of Article-19-1(a) of the Indian Constitution.

Such coward acts started a ways back but as the last such event which clicks my mind is the literary+cyber+verbal+physical war against 'The Satanic Verses' by Salman Rushdie.One might agree with someone or not but should not hammer on the freedom of speech of that personality and the crux of  the issue is that Govt. also found itself in a whirlpool and so favors the side in majority irrespective of the point that it is abide by the law or constitution or not.People says 'On the name of freedom of speech' one can't hit the sentiments of someone.I say this philosophy is a nonsense if you talk about freedom of speech and right of expression.One should have suffice bearing capability before reacting in a democracy having freedom of speech.Each and every matter or sentence or will have followers or haters,does this mean that the a person won't express his/her views even after living in a democracy which provides the Right of Expression and Freedom of Speech.

Last few months in India include several such examples in which attempts were made to cut the wings of the 'Freedom of Speech',some were desperate and some in progress.A discussion on cutting feathers of 'Right To Information Act',to make CAG a multi-member body,to shoot the messenger and now misusing Article-66(a) of IT-act in accusing two girls who just put there views on the digital canvas on social media.Is this acceptable in the World's largest Democracy??

If you are not agree with someone's view,please be have a patience to bear,think before reaction,that surely would give a better outcome. 

I would again say........People Need to Rethink a lot.

International Men's Day - On Birth Anniversary of a Powerful Lady- Interesting

In a male dominant society,19th Nov is being celebrated as International Men's Day,sounds interesting.Started in 1999 from Trinidad and Tobago now being celebrated in over 60 countries including India.Everyone might have heard about 8th March- International Women's Day.The thought might have stroked probably in some male's mind - why only women's day why not men's,in fact this clicked in my mind and today when I came to know about the occasion it was a surprise for me,especially on the birthday of a renowned lady who was one of the most powerful lady at times,the former Prime Minister of India-Indira Gandhi.Probably this might also be a reason for choosing the day,but this wasn't.


The main aim behind celebration of the day for men is mainly gender equality which might be in danger in future on continuous efforts for female growth only.Other reasons include health caring for males of all ages,highlighting positive male role models in front of the world.This occasion also highlights the contribution and roles of the males towards family,society and rest of the world.In fact, in favor of women empowerment sometimes only the bad elements in the male community are highlighted,this occasion provides a chance to also highlight great contributors of males in a formalized way.

Don't know,how much useful is this but surely sounds sarcastically interesting in this male dominant society.Presently,women empowerment is a big need of the times and each country is equally focusing on the same and should be done as well.Thinking on a positive node,this should also be an occasion of pleasure for women's too that yes gender equality needs to be assured and so Men's Day has also been started to be celebrate worldwide.'Shakti Diwas' and 'International Men's Day' both on the same day indicating the increasing power of a woman that indeed is the need of the time & a women must be happy thereafter !!!!
